Topic: Take This Job & Shove It (But, I’ll See You Tomorrow) – What Constitutes Protected Activity Under the NLRA
The NLRB has become more aggressive in what constitutes protected concerted activity by employees, especially in the social media context. It is essential for employers, both union and non-union, to understand the parameters and issues of what is and is not protected concerted activity when dealing to disruptive and abusive employees. Using snippets from actual cases, we will review what the NLRB has said is protected concerted activity, and what is not. We will also look at the social media cases and the interplay with employees’ Section 7 rights.
I. Review of Section7 and Sections 8(a)(1) & (3) of the NLRA
II. Review the NLRB’s standards for determining when concerted activity is protected and when it loses its protection
IV. Review and discuss case scenarios regarding protected concerted activity and social media.
