    WHEN THE ADA COMES AT YOU FAST

    If you still think “substantial limitations,” “barrier removal” and “path of travel” are self-enlightenment concepts – you may be in trouble.
     
    What the EEOC’s 2011 Amendments and the DOJ’s 2012 accessibility requirements mean to your business.
    I.        Brief overview of the ADA
     
    II.       The EEOC’s Amendments (Title I)
              a.The expanding definition of disability
              b “Substantial limitations” don’t need to be so substantial
              c. More people will be regarded as disabled
     
    III.    The DOJ’s Accessibility Requirements (Title III)
            a. Public accommodations and commercial facilities
            b. From guidelines to requirements, and which standards apply
            c. New requirements – Miniature horses, Segways and other considerations
            d. Barrier removal
            e. How the “safe harbors” apply
     
     IV.    Don’t Blink
            a.DOJ will likely revise to be consistent with EEOC’s expanded definitions
            b. Assess, plan, budget, schedule
